“The United States Supreme Court took a constitutional right,” Harris says. “The United States Congress has the power to put in place a protection of that individual privacy right that all Americans should be entitled to.”
Harris promises that President Biden, presented with the opportunity to sign legislation codifying the individual privacy right previously protected by Roe v. Wade, will sign it.
Harris’s pledge stirred anger from Pro-Life advocates and questions from other responders about why codification wasn’t done by Congress during the past 50 years.

In the 50 YEARS since the original Roe v Wade case was decided, why didn’t congress codify Roe? Why didn’t this happen at any point over the past 5 DECADES, prior to the recent Dobbs decision?
Another commenter also asks why the codification effort has been dormant for half a century, and adds to it questions about the ability of Congress and the administration to deliver, lamenting their track record: “u had like 50 years to do this…You still haven’t even delivered on the Student Loan promises. Why should people trust you to follow through on this?”
The latter commenter warned about what complacency, and talking rather than legislating, could mean for the Biden-Harris 2024 ticket:. “You have to deliver on your promises at some point,” they write “or RFK is going to eat your lunch.”
